City of Marco Island, Florida BE A GOOD NEIGHBOR - Quality of Life Matters
The City of Marco Island provides several ordinances that address potential problems of noise, improper parking, loud parties and other disturbances in residential neighborhoods to help maintain the quality of life.
What constitutes a noise violation? It is unlawful to make any noise that is excessive, including but not limited to: • Radios, stereos, audio-visual equipment, sound or amplification equipment, television loudspeakers, yelling, shouting, boisterous conduct, and skateboard ramps between 10:00 p.m. and 7:00 a.m.; • Construction equipment between 7:00 p.m. and 7:00 a.m. or on holidays; • Landscaping maintenance, including air blowers or vacuums, between 9:00 p.m. to 7:00 a.m.; • Vehicles with loud music or without mufflers/original mufflers; • Animal noises, such as barking dogs or loud birds. What about parties and disruptions like parking, trash or noise? In addition to the specifics outlined within this flyer that cover litter, noise and parking, the City’s Code addresses public nuisances. Public nuisance means the act, by any person, or the keeping, maintaining, propagation, existence or permitting of anything, by any person, by which the life, health, safety, or welfare of any person may be threatened or impaired. If a party gets too noisy, or the music is vibrating the windows at the neighbor’s home, these may unreasonably interfere with the customary use and enjoyment of life or property and may constitute a public nuisance. What is the requirement for placing waste receptacles at the curb? Trash receptacles, including bagged garbage, yard waste, recycle bin, or bulk items, should be placed out by the curb (handles facing the house) of their property for trash pickup after 6:00 p.m. of the evening before the scheduled pickup day. The receptacles should be removed and place them inside the garage or to the side or rear of their dwelling by 7:00 p.m. on the evening of trash pickup. What does the code say about parking? Vehicles must be parked on an approved hard surface not on the street or sidewalk. Parking on an unimproved lot is prohibited. Parking is not allowed in the swale areas between the hours of 2:00 a.m. and 6:00 a.m., near a fire hydrant or traffic control device. Vehicles in your driveway may not be parked over sidewalks at any time. All vehicles must have a current license plate and be insured. Vehicles must be stored in the garage for restoration projects or if not immediately operable. Boats and boat trailers may not be parked in driveways or vacant lots. With a City permit, recreational vehicles can be parked for up to 28 days per year. What are the driving issues that should be adhered to in local neighborhoods? Unless otherwise posted, the speed limit is 30 miles per hour (mph). Drivers must yield to pedestrians, and stop at stop signs. If operating a vessel in a canal or interior waterway around Marco Island you should do so at idle speed and generate no wake. What are the watering restrictions for residential properties? Irrigation is permitted from midnight to 8:00a.m. on both days listed: Monday & Thursday Property address with last digit 1 and 2, Wednesday & Saturday Property address with last digit 3 and 4, Thursday & Monday Property address with last digit 5 and 6, Friday No Irrigation Allowed, Saturday & Tuesday Property address with last digit 7 and 8, Sunday & Wednesday Property address with last digit 9 and 0, Note: The restrictions apply to all irrigation, including hose connected sprinklers. What are the restrictions on local beaches and/or fishing from vacant land? Dogs, fire pits and glass are not allowed on any beach area on Marco Island. Fishing from land now requires a State of Florida fishing license, with few exceptions. Additionally, no fishing is allowed on a vacant lot without expressed written consent from the owner of the property. What are the restrictions for seawalls and or docks? All seawalls and docks must be maintained in a structurally sound condition. Seawalls are connected, so one that is not maintained may impact more than one seawall. What are the requirements for swimming pools? Swimming pools are required to have an exterior barrier to restrict access from the yard area to the swimming pool. Examples include a screen enclosure, fencing or child’s safety fence. Pools also must be maintained to avoid any health or nuisance conditions. What is the legal drinking age on Marco Island? The drinking age in the State of Florida and on Marco Island is twenty-one (21) years of age. When is a yard or lot overgrown? Grasses or weeds that exceed 15 inches high are a violation of the City Code. Owners of developed or undeveloped lots should control all excessive growth by cutting or removing the grasses and weeds. The practice of scalping or removing grass by clearing the topsoil is prohibited. What is illegal dumping or littering? The most common illegal dumping or littering occurs from landscaping or horticultural debris. Yard debris should not be dumped on or in front of vacant lots. Waste Management does not pick up from vacant lots. Litter and pollution mean any garbage, trash, fluid other than uncontaminated water, household waste, furniture, aluminum or tin cans, refuse, paper, glass, metal, plastic, cloth, wood, sweepings, abandoned property, oil, grease, dead animal carcass, animal waste, bacterial growth, algae, insects, larvae, or other foreign matter which is obnoxious or offensive. This does include pet owners walking their dogs. They need to be responsible and pick up the pet waste. How do I report a problem?
